Deputy Chairman of the Constitutional Court (MK) of the Republic of Indonesia Prof. Aswanto give a public lecture in UIN Alauddin Makassar, Friday (02/07/2020). Lecture on the theme "The Constitutional Court Law Amid the political arena Nation Post-Reformation", was attended by Rector Prof Hamdan UIN Alauddin Juhannis green campus and a number of officials.
In front of hundreds of participants consisting of lecturers and students, Prof. Aswanto explains the role of the Court to the political system of law in Indonesia. He argued that Indonesia still tend to subscribe to the theory of law in the sense rechtsstaat state, where the laws that must be obeyed is what is in the legislation. And he said, the law itself can not be separated from politics, so many laws we actually substance is not justice, but the interests of political parties.
"That is why when the reformation friends activists, professors and students who concentrated on the issue, wants Indonesia is not merely a state of law within the meaning of the legislation, but we have to transform our country into a state of law in the context of the rule of law, that is to say substance of the law must be a sense of justice "he said.
So, he added, should not be considered if we do not obey what is in the legislation, we then become dissidents law, is not the case, because now we've bergerser than state law in the sense rechtsstaat be become state law within the meaning of the rule of law , The rule of law that if there are laws that are written in the law, contrary to the values ??that live and thrive in the community, then we should not obey.
"Constitutional Court as the constitutional mandate of Article 24 C of paragraphs 1 and 2, was given the task and authority are closely linked to the paradigm shift from mere rechtsstaat be a rule of law that, when the president or the government together with the House of Representatives to form a law, the Court has the authority to assess whether the existing norms in the law in accordance with the constitution or not "he concluded.
Alauddin State Islamic University Rector Prof Hamdan Juhannis revealed that the presence of Prof. Aswanto be a blessing for UIN Alauddin. For him professor of the Faculty of Law, University of Hasanuddin it does have a lot of breakthroughs, one of which served as dean of the Faculty of Law, Hasanuddin University. In addition, the topics raised in the public lecture, is very important to him, in the midst of legal and political problems that occur.
